Using a regional 485 in 2026: how the extra years support a PR strategy

How the regional second 485 works in 2026, what the extra time can do for a 190 or 491 plan, and what it cannot do.

Published:

A second or subsequent Post-Higher Education Work stream 485 adds time in Australia, and the regional residence it requires builds the same kind of record that state nomination and regional skilled pathways generally look at. It does not convert into permanent residency by itself. The extension is granted on what you have already done — two years living, working or studying in a designated regional area while holding your first 485 — plus a declaration that you intend to stay regional. Nomination is decided against separate criteria. This article draws on the Migration Regulations 1994 as published on the Federal Register of Legislation and the Department of Home Affairs' Temporary Graduate visa (subclass 485) page, together with the Department's PAM3 procedural guidance; both are revised from time to time, so the current position should be confirmed there.

What does the second regional 485 actually require?

Four things, set out in the PAM3 decision path for second and subsequent Post-Higher Education Work stream applications:

  • You held a qualifying first 485.
  • Your qualifying course was completed at a campus in a designated regional area.
  • You lived, worked or studied in a designated regional area for two years while you held that first 485.
  • You declare that you will continue to live, work or study only in a designated regional area.

The regulations carry the regional residence criteria in clauses 485.232 to 485.235, and failing to satisfy them is listed among the common grounds for refusal.

The timing matters more than most applicants expect. The two-year qualifying period is measured while you hold the first 485, so the clock that earns you the extension runs before you apply, not after. The extension itself is forward-looking time.

Two exemptions follow from meeting the subsequent visa clauses: the English language requirement in clause 485.212 does not apply, and neither does the requirement in clause 485.213 to show evidence of having applied for an Australian Federal Police certificate. Health insurance (clause 485.215) and the character and health criteria still apply.

Does that regional time carry over to a 190 or 491?

Nothing in the 485 criteria grants you nomination. The 190 and 491 subclasses have their own criteria, and each state and territory publishes and revises its own nomination criteria independently. What you carry forward from a regional 485 is different from what you need for nomination: you carry forward lawful time in Australia to keep building skilled work experience, and a documented record of where you actually lived.

This article covers the 485 rules; nomination criteria sit in separate instruments and state publications and change frequently, so treat any assumption about how your regional time will be counted as provisional. This is general information about how the pieces fit together, not an assessment of your circumstances, and the current settings should be confirmed on the official pages.

What does the declaration commit you to?

The declaration is not a formality. You state that you will live, work and study only in a designated regional area, and the PAM3 guidance lists condition 8610 — a regional limitation — among the conditions attached at grant. The geography you commit to on the 485 is the same geography that regional skilled pathways are built around, which is the point: the obligation and the strategy point in the same direction, and drifting out of the region undermines both at once.

Where the extra time helps, and where it does not

It helps with It does not do
More lawful time in Australia to build skilled work experience Meet any 190 or 491 criterion on its own
A continuous, documented regional residence record Prove regional residence without supporting evidence
Time to meet a state's criteria as they are published at the time Lock in criteria, which states revise
Avoiding a fresh English test or police certificate application (subsequent visa clauses) Remove health insurance, character or health requirements

How to use the time, in order

  1. Confirm your campus and your residential address both fall in a designated regional area.
  2. Build one continuous address history across the whole of your first 485.
  3. Record every departure from the region, with dates and reasons.
  4. Lodge the extension while you still hold the qualifying 485 and can evidence the full two years.
  5. Read the conditions on your grant letter, including any regional limitation.
  6. Keep working in the region in the occupation you intend to nominate.
  7. Re-check the relevant state or territory criteria mid-way through the extension.

What puts the plan at risk

The regional residence requirement is the weak point. If the two years cannot be evidenced, the extension is refused and the time you were planning to use disappears. A declaration that does not match where you actually live creates the same problem from the other direction, and submitting anything inaccurate engages PIC 4020, which carries consequences well beyond a single refusal. The last risk is quieter: building a plan around nomination criteria that have since been revised, and only discovering the change when the extra time has almost run out.

Frequently Asked Questions

Do I need a new English test for the second regional 485?

No, if you are meeting the subsequent visa clauses (485.232 to 485.235). The regulations provide that the English language requirement in clause 485.212 does not apply to those applicants. Requirements for other streams and for first applications are unchanged.

Do the two years have to be unbroken?

The requirement is two years living, working or studying in a designated regional area while holding the first 485. The PAM3 guidance treats short holidays as generally not breaking the pattern, but the decision-maker still has to be satisfied about continuous residence, so records matter.

Does the extra 485 time guarantee state nomination?

No. Nomination is decided against separate criteria published by each state and territory, and those criteria change. The extension gives you time and a residence record, not an entitlement.

Can I move to a major city after the second 485 is granted?

That conflicts with both the declaration you made and the regional limitation the PAM3 guidance lists as a grant condition. Moving out of a designated regional area puts the visa out of step with its own conditions.

What if my campus was regional but I lived elsewhere?

The requirement looks at where you lived, worked or studied, not only where your classes were held. A regional campus with a metropolitan address may not satisfy the two-year residence test.

What evidence should I keep for the regional period?

Keep records that show your address and your activity across the full two years. The PAM3 guidance points to leases, utility and internet bills, and bank statements as the kinds of documents that establish where you were living.

What happens if the second 485 is refused on the regional ground?

You lose the additional time the plan depended on, and any nomination timing built around it has to be rebuilt. Review rights and their deadlines are set out in the refusal notice; merits review is conducted by the Administrative Review Tribunal.
